GOP States Sue Feds to Block Mail Order Abortion Pills

(Worthy News) – A coalition of three Republican-leaning states filed a lawsuit on Monday against the Food and Drug Administration and the Department of Health and Senior Services. The lawsuit challenges the approval of the abortion pill mifepristone and its distribution to patients across the nation, even in states where abortion has been prohibited, Courthouse News reports.

In their legal filing, the Republican attorneys general from Missouri, Kansas, and Idaho draw upon what they refer to as a precedent set in the Texas case Alliance for Hippocratic Medicine v. FDA. In this case, a federal judge appointed by Donald Trump issued a preliminary injunction in April. This injunction favored the plaintiffs and raised questions about the FDA’s initial approval process for the drug, which was approved more than 20 years ago.

Following an emergency appeal, the U.S. Supreme Court temporarily suspended the injunction during ongoing proceedings.

The Court observed that the plaintiffs had not demonstrated sufficient harm to warrant immediate relief.

In their recent complaint filed on Monday, the Republican attorney generals seek to strengthen their case by asserting that the surge in prescriptions following the FDA’s 2019 approval of generic mifepristone has led to a corresponding rise in complications and hospitalizations related to the drug’s usage.

“Unelected federal bureaucrats do not have the statutory authority to approve the shipment of these dangerous chemical abortion drugs in the mail,” said  Missouri Attorney General Bailey in a press statement released Monday.

“The U.S. Food and Drug Administration (FDA) has the statutory responsibility to protect the health, safety, and welfare of all Americans by rejecting or limiting the use of drugs dangerous to the public,” Bailey continued.

“The FDA has failed in this responsibility. Specifically, it failed America’s women and girls when it chose politics over science and approved risky, untested chemical abortion drugs for use in the United States. And it has continued to fail them by turning a blind eye to these harms and repeatedly removing even the most basic precautionary requirements associated with the use of these risky drugs,” Bailey concluded.
